Written in a time when the Republic still stood and no 14th Amendment hang-ups to complicate the matters. This book by Rollin Hurd written in 1858 covers anything one would need to know about all the uses of this "Writ of right". You will find that it can be used to bring a wife or Husband out of a home when one filed or had filed to be brought forward. The Writ of Habeas Corpus is the only writ that is labeled a writ of Right. It is the only writ that can not be turned down whereas the other writs( Certiorari, Mandamus’s, Etc) are by discretion and can be turned down at the pleasure of the judges. But the writ of Habeas Corpus has to be answered if filed right. In fact this book shows that a Judge must hear it even if the court is in vacation. And shows that a judge could be fined $1000.00 if he refused to act upon it. There is no better right written into the Constitution (Federal or States) that can match this right of having the right to a writ of Habeas Corpus. After all, what good is your right of free speech, bearing arms, Christian Religion, and all the other rights stated in the Constitution if you are setting in jail with no means to see the Judge about your unlawful incarceration? This is the book to have on the subject. What you will learn in this book will be so valuable that you will thank yourself a 1000 times for getting a copy. It is packed with over 600 pages of information beginning with exceptions of personal liberties such as wards of the State , children, wives, Citizens that have testimony for the State and refuses to testify, Contempt of court and a few other exceptions. Then a complete course in the right of the Writ and how to file one and which Writ to file for what circumstances. It also goes on about the Slave issue and what can the purpose of the writ for a run away slave. Right now, the Law book exchange is having a reprint of it for 100.00 and up. To find this book in its original print is next to impossible. Don’t think for a minute that the books I have been putting up (and have up now) came to me with ease or with a low cost but with much labor and many dollars.
