This book is one of the best ever on the subject of the 14th amendment and how it affected the States. It is one of the few books that the supreme Court Quoted from in a ruling. This is one of the hardest books to get. The reason I don’t know, but I have only found two copies in constant search in a three year span. The book is written by Charles Wallace Collins and he goes into the problems of the 14th Amendment and how it has caused confusion. If he had lived to see where it is today he would have seen how important his work really was. However it seems it has been lost in the shuffle somehow and just did not get popular enough for scholars and jurist to make use of it. Or, they didn’t want too make use of it. It enlightens the reader on many historical facts that I am sure the modern reader is not aware of. In fact it has convinced me that the amendment needs repealed. Mr. Collins proves that the amendment did not really pass, but was forced through with "Political trickery". The Amendment (As proved by Collins) had nothing to do with what the supreme Court came to use it for, but it soon came to be the Corporations’ "Magna Charta" Collins proves that while the amendment was meant to constitutionalize the civil rights act of 1866 for the Black race he shows that only 16 cases went up to the supreme Court by the time he had written his book in 1912, but 100's of cases came flooding the supreme Court from the giant Corporations getting out of taxes and other regulation This book is one of the best ever on the subject of the 14th amendment and how it affected the States. The legal term was called The "Twilight Zone". It allowed corporations to operate with neither State or Federal control. Once the Corporation filed against the State, then they had injunctions to leave them along and the federal position was that they could only place the injunction until the matter is heard and nothing else. This put the corporations in a great position to function with no state or federal government regulating them for about three years. This also tax freed them those years. * * * Collins also shows that the doctrine of Stare Decisis was of none effect because of the confusions the court had made on the subject. He shows where both sides of any party’s argument going to the supreme Court could quote as many as 15 to 20 rulings that favored their own side. It was a mess and still is, Even worst. I personally call the 14th Amendment "The Mandrake Amendment" Because it seems to be so magical, the rabbits being pulled out and the many unheard of doctrines pouring out from the Supreme Court never heard of before and definitely never heard of in the 39th congress that debated the subject. It has cause what I term "Judicial Rule" to run this country. We no longer need legislative’s, all we need to do is just ask the 9 Justices what is, and they will send out the creed to all the states what shall be. I also call it The "Judicial Codeus Mandamus", that is where the supreme Court changes laws by their rulings and the States except their rulings as if they were law. Sort of like sending out a Mandamus over the nation. What ever it is, it is not what this book will point out in the history of the 14th amendment.
